Nosotros Reciclamos - We Recycle

Transforms garbage materials and people's lives. The objective of the project is to teach the pepenadores - people who survive collecting garbage in the streets - to transform the waste into jewelry and decorative items. This allows them to have an alternative to obtain income while having medical service and psychological support to improve their living situation. We Recycle is a cooperative partnership project launched in 2014 thanks to the collaboration between the Asociación Proyecto Nauyaca (Switzerland) and Proyecto La Carpa (Mexico) and the support of the partners Valais Solidaire and Avina Stiftung.

KuzaFi Switzerland Ltd. is a financial intermediary domiciled in Switzerland, is linked to the self-regulatory organization PolyReg recognized at the federal level (SRO) according to Article 24 of the Money Laundering Law. In accordance with its regulations, it complies with the legal obligations of supervision, supervision of its members and is subject to the supervision of the Financial Market Supervision Authority of Switzerland, FINMA.

Privacy policy

KuzaFi is committed to protecting the privacy of its customers ("the sender(s)") and any personal information which is collected shall be in accordance with the Swiss Data Protection Act and laws, rules or applicable regulations issued thereunder. The company will take all    the necessary precautions to prevent unauthorized access to the client's personal information and will not be able to disclose the client's information to third parties without the prior consent of the user unless bound to do so by law. Data collected on the Customer may have to be disclosed to judicial, administrative or regulatory authorities in accordance with the relevant applicable legislation.

The company aims to safeguard the security of the data collected with physical, electronic and administrative procedures, however, it cannot guarantee that any data transmission over the internet is completely secure.

The client can contact the company to review and update their personal information.

By providing data to KuzaFi, the client authorizes and consents to the use of such data by the company and its authorized third-party service providers for the purpose of executing a money transfer. In addition, it also gives its consent to the company and its third-party service providers for the retention and use of the data related to each money transfer transaction in order to comply with the applicable legal requirements. The data can be used by KuzaFi in order to send information to the client; however, in no case will they be disclosed to third parties for commercial or promotional purposes. Whenever you have expressed your consent to this, we will use your data in the framework of our marketing in order to inform you in time about new products and other news or business promotions. You can revoke your consent at any time.

Server log files

Our website provider automatically collects and stores information that your browser automatically transmits to us in so-called server log files. The information in these files consists of:

  • Browser type/browser version
  • Operating system used
  • Referent URL
  • Host name of accessing computer
  • Server request time
These data can not be associated with specific people. No combination of these data will be made with other sources of information. We reserve the right to examine this information a posteriori in the event that concrete evidence of illegal use is being made available to us.

What are cookies?

The KuzaFi Online Service offers the service of money transfers and assists customers to send money to their family and friends all over the world. KuzaFi is located in Switzerland, Wallis, CH-3953 Leuk-Stadt, and his Commercial Register Number is CH-600.4.016.528-6 at the Commercial Register in Leuk-Stadt. According to FINMA regulations, KuzaFi Switzerland GmbH is affiliated to a recognized self-regulatory organization in Switzerland.

If you are 18 years old, the agreement with us is according these Terms and Conditions.

These Terms and Conditions apply to and govern your access to and use of the KuzaFi Online Website and the services available on the KuzaFi Online Website.

It is important that you read and understand our Terms and Conditions before you accept them. They contain limitations on the scope of our obligations to you, as well as limitations on and exemptions from our liability to you in the event that you suffer loss as a result of using our services. We have highlighted in bold those provisions which do this.

As used in our Terms and Conditions, the terms:

(a)   "bank card" refers to a Visa® or MasterCard® credit card or debit card issued by or through a bank;

(b)   "card issuer" refers to the issuer and owner of a bank card;

(c)   "Prohibited Purpose" refers to any unlawful purpose; to making or receiving payments for gambling services, gambling chips or gambling credits; or to sending a payment to yourself as the receiver in order to evidence financial soundness (RISK OF FRAUD); or sending or receiving money on behalf of someone else;

(d)   "beneficiary or recipient" refers to the person identified as the beneficiary of a money transfer (regardless of whether the transfer is initiated by the client or a sender using the KuzaFi Online Service or by another person using any other KuzaFi money transfer service);

(e)   "client or sender" refers to the person who initiates the money transfer by using the KuzaFi Online Service;

(f)    "transaction" refers to each money transfer that you initiate under, and each other use that you make of the KuzaFi Online Service;

(g)   "KuzaFi", "we", "our" , "us"or “KZF” refers to KuzaFi Switzerland Ltd.;

(h)   "KuzaFi Online Service" refers to all of the services which are available on the KuzaFi Online Site;

(i)    "KuzaFi Online Site" or "Site" refers to the website operated by us to provide online funds transfer services to other countries;

(j)    "you" or "your" refers to any person who uses the KuzaFi Online Site or the KuzaFi Online Service as a client or sender.

 

1. Our responsability with respect to you

1.1 Our agreement with you is that we will take reasonable care to provide the KuzaFi Online Service. As such, we agree to provide you with the money transmission as well as the related information features that are periodically described in the KuzaFi online site.

1.2 We have no obligation to you to initiate or perform a money transfer or other transaction as part of the KuzaFi Online Service if:

(a) we are unable to obtain satisfactory evidence of your identity;

(b) we have reason to believe that the transaction is incorrect, unauthorized or forged;

(c) you provide us with incorrect or incomplete information or if your transaction is not given to us sufficiently in advance to allow for timely provision of the requested transaction;

(d) your card issuer does not authorize your use of your bank card for payment of the transaction and our related charges.

1.3 We do not accept any liability for damages resulting from non-payment or delay in the payment of a money transfer to a recipient or from the non-performance of a transaction through the KuzaFi Online Service by any of these reasons.

1.4 We may refuse to provide the KuzaFi Online Service (in whole or in part) to you if to do so may breach any KuzaFi policy (including policies intended to prevent fraud, money laundering or terrorist financing) and/or any applicable law, order of a court or requirement of any regulatory or governmental authority, body or agency having jurisdiction over us, or if we otherwise consider such action necessary to protect our interests. However, if we refuse to provide the KuzaFi Online Service (in whole or in part) for any of these reasons, we will wherever practicable notify you that we have done so and, unless we are prevented from doing so for some legal reason, we will explain why we have done so.

1.5 We may suspend the operation of the KuzaFi Online Site or the KuzaFi Online Service in whole or in part if, in our absolute discretion, we consider it appropriate to do so by reason of any circumstances beyond our control. We undertake that if the services provided by the KuzaFi Online Site or the KuzaFi Online Service are interrupted (whether by us, any third party service provider or otherwise) for any reason, we will take reasonable care to minimise the duration of any interruption. As long as we honor this commitment, we will not be liable  for any loss you may suffer or for any liability that you acquire as a result of such interruption; except for the case that the interruption derives from our intentional misconduct or gross negligence.

1.6 We will generally communicate with you through the Internet and by e-mail. But this does not affect your right to communicate with us through the means described in clause 5 below, under the circumstances referred to in those provisions. 

 

2. Your responsibility to us

2.1 You agree to pay our charges for each money transfer or other transaction which you initiate or request under the KuzaFi Online Service. Information explaining our charges can be viewed by using the "Online calculator" feature, which provides the cost of sending an online money transfer.

2.2 You must pay the full amount of the funds transfer and our rates using a bank card. Each time you use the KuzaFi Online Service, you agree that we are authorised to charge your card issuer for the principal amount of any money transfer and our charges relating to the relevant transaction before we perform the money transfer or other transaction. The amount that we will charge to your card issuer will be notified to you prior your final authorisation of the transaction.

2.3 You acknowledge and agree that:

(a) when you register with us, you will provide us with true, accurate, current and complete information;

(b) you will be responsible for the maintenance and updating of this information when appropriate, so that it is always true, accurate, updated and complete;

(c) you will not use the KuzaFi Online Service for or in connection with any prohibited purpose;

(d) you will not initiate a money transfer or other transaction under the KuzaFi Online Service that violates the Terms and Conditions or any other restriction or requirement of use described on the KuzaFi Online Site;  

(e) you are responsible for the security of your password and e-mail account log-in in accordance with clause 7 below. Please inform us immediately (by telephone or e-mail as described in clause 5 below) once you have a loss, theft or appropriation due to unauthorized use of the service or for any unauthorized or improperly executed transaction. Any such notification must be given no later than 3 months after the date of the transaction.

2.4 You also acknowledge and agree that we periodically provide information about you, as well as the services we provide to regulatory and governmental authorities or agencies when:

(a) we are required by law to do so; or

(b) if we determine that such disclosure may help to combat fraud, money laundering offences or other criminal activity.

2.5 You agree that you will generally communicate with us through the Internet and by e-mail at the following address: support@kuzafi.com. But this does not affect your right to communicate with us through the means described in clause 5, below, in the circumstances contemplated in those provisions.

 

3. Foreign Exchange.

The amounts shown in our website in local currency at any given moment are based on real-time exchange rates. KuzaFi negotiates the best rates on the market for the benefit of our customers, and the exchange rates are calculated in real time. Therefore, the exchange rate applied at the time of completing the transaction may differ from the one displayed at another moment in our website. The displayed amounts are always inclusive of KuzaFi's business risk.

 

4. Cancellation and Refunds

4.1 Your right of cancellation under the laws relating to online contracts is in addition to your cancellation rights as  a client or sender.  As a client or remitter of funds transfer you have the following rights:

(a) KuzaFi will refund the principal amount of a money transfer and the transfer fee upon the Sender's written request to the address above by letter or email in case:

(I)    the client or remitter cancels, no fraud is detected, the money hasn't been delivered and the sender's credit card has not been charged; or

(II)   the client or remitter cancels, fraud is detected, the money hasn't been delivered, and the sender's credit card has not been charged; or

(III)  the transaction is declined by KuzaFi; or

(IV)  the client or remitter wants to make a change, but KuzaFi requires the transaction to be canceled before making the change; or

(V)   the money transfer is not available in a active cuban debit card to the receiver within five 5 business days, subject to conditions beyond the control of KuzaFi, such as legal requirements, inclement weather or telecommunications failure.

(b) KuzaFi will refund only the principal amount of a money transfer upon the Customer's written request to the address above by letter or e-mail and apply fixed processing fee of 2 EUR / USD in case that:

(I)    the receiver rejects the transfer; or

(II)   the client or remitter cancels the transfer, no fraud is detected, and the client or remitter's credit card has been charged; or

(III)  the client or remitter cancels the transfer, fraud is detected, the money hasn't been delivered, and the remitter's credit card has been charged; or

(IV)  the payment to the receiver is not made within 45 days.

4.2 To the extent pernitted by law, KuzaFi may deduct an administrative fee to transfers of funds that are not picked up within one year of the send date.

6. Registration

You will be required to register with us in order to use the KuzaFi Online Service. Registration is subject to these Terms and Conditions.

 

7. Password and Security

You will choose a password and an e-mail account login upon registering with us. You are responsible for maintaining the confidentiality of your password and the login credentials to KuzaFi account, and are fully responsible to us for all activities that occur under your password or access to your KuzaFi account. You agree to notify us immediately, by contacting us, any unauthorized use of your password or access to your KuzaFi account, as well as any other security breach. Once you have told us that there has been an unauthorized use of your password or e-mail account login, we will take immediate steps to prevent these from being used. Subject to our taking such measures, we are not liable for any loss or damage arising from failure to comply with your obligations under clause 5 or this clause.

 

8. Disclosure of account information to third parties

The sender agrees that all related data shall be transferred to KuzaFi and its authorized distributors partner for the purpose of the execution of the money transfer. Furthermore, he/she also consents to the retention and use by KuzaFi and its authorized agents of the data pertaining to every transaction for the purpose of complying with applicable legal requirements.

The data may be used by KuzaFi to provide the customer with information about futures sales promotion, but in no case the data will be delivered to a third party for its use for marketing or promotional purposes.

 

9. Liability

In no event shall KuzaFi be liable for damages caused by delay, non-delivery, non-payment or lesser payment for the money transfer, or any collateral damage, whether or not caused by negligence on the part of its employees or agents. In no event will KuzaFi be liable for any indirect, special, incidental or consequential damages. If KuzaFi accepts a money transfer or other negotiable form of payment from the sender, it assumes no obligation in the case of payment being uncollectable by the receiver, nor does KuzaFi assume any liability for damages resulting from non-payment of the money transfer deriving from such uncollectability.

 

10. Entire Agreement

These Terms and Conditions, together with all the documents referred to in them, constitute the entire agreement between you and us and replace and terminate all prior agreements that you may have entered with us.



11. Transfer

We have the right to transfer, assign or delegate our rights and/or responsibilities in whole or in part under our agreement with you to an affiliated company, or any third party, at any time without your consent unless such transfer would reduce your rights and/or remedies or increase your responsibilities and/or liabilities under your agreement with us. You may not transfer your rights and/or responsibilities under your agreement with us without our prior written consent.

 

12. Severability

In the event any one or more of the provisions of these Terms and Conditions shall for any reason be held to be invalid, illegal or unenforceable, the remaining provisions shall remain valid and enforceable.

 

13. Local regulations

The customers (both sender and receiver) who are using our service must respect all national legal and regulatory rules. We decline all kind of responsibility or legal problems which may occur to customers not respecting the rules set by their national government. The range of money transfers we accept and deliver has to be between 30 and 2’000 Euro or its equivalent. Amounts outside this range will not be processed.

The sender cannot revoke a transaction previously released. If a transaction cannot be completed for a reason for which KuzaFi is not responsible, the sender remains liable to cover any costs caused by the unsuccessful remittance.

 

14. Termination and suspension

14.1 Either you or we may terminate the agreement between us upon giving not less than 1 day's notice.

14.2 You shall notify us immediately if any of the following events occurs:

(a) you become, or are likely to become, insolvent or are declared bankrupt;

(b) any other event which affects or might affect your ability to perform your agreement with us.

14.3 We may terminate our agreement with you and/or suspend KuzaFi's online service (in whole or in part) in relation to you with immediate effect and without prior notice to you if:

(a) any event set out in clause 14.2 occurs;

(b) you are in breach of any provision of these Terms and Conditions;

(c) it appears to us that you have become or are likely to become mentally incapable of managing your property and affairs, or any other event occurs which affects your legal capacity or ability to contract with us on our Terms and Conditions; and

(d) your use of the KuzaFi online service or the Site is disruptive to our other customers.

14.4 We may terminate our agreement with you and/or suspend the KuzaFi online service on the basis of information supplied to us (whether orally or in writing) that we in good faith believe to be untrue.

14.5 The termination of our agreement with you and/or the suspension of KuzaFi's online service will not affect any rights or obligations arising befor or arising during or after the date of termination or suspension or which arise in consequence of it, and all such rights and obligations will remain to be subject to these Terms and Conditions.

14.6 Excluded is liability for measures resulting from the General Terms and Conditions, the restrictions or requirements in connection with the use of KuzaFi's online service. This also includes the dissolution and / or blocking pursuant to Clause 14.

14.7 The provisions of our agreement with you shall continue to apply during any suspension of the KuzaFi Online Service. The provisions of clauses shall survive any termination of our agreement with you.
